Terms & Conditions (Resume Mobility Physical Therapy, LLC)

Welcome to Resume Mobility Physical Therapy, LLC ("Company," "we," "us," or "our"). These Terms & Conditions ("Agreement") govern your access to, and use of our virtual physical therapy services provided through telehealth platforms.

By using our services, you acknowledge and agree to comply with these Terms & Conditions. If you do not agree, you must discontinue using our services immediately.

1. Definitions
   • "Services": Virtual (online) physical therapy assessments, consultations, treatments, and education provided by licensed physical therapist(s).
   • "Patient" or "You": The individual receiving the telehealth or virtual physical therapy services.
   • "Provider": A licensed physical therapist providing telehealth physical therapy.
   • "Telehealth" or "Virtual": The delivery of physical therapy services using electronic communication technologies.
   • "Platform": The website, mobile app, or telehealth software used to conduct virtual therapy sessions.
   • "Superbill": A document provided to the patient detailing services rendered for potential insurance reimbursement.

2. Eligibility for Virtual Physical Therapy
To use our virtual physical therapy services, you must:
   • Be at least 18 years old or have a parent/legal guardian's consent if under 18 years old. As of now, we are providing services to patient age groups between 5 years to 64 years.
   • Be physically located in South Carolina or North Carolina at the time of your appointment or session.
   • Provide accurate and up-to-date medical history.
   • Confirm that you do not require emergency care or in-person evaluation before starting telehealth physical therapy.
   • Acknowledge that virtual physical therapy may not be appropriate for all medical conditions, and our providers may refer you to an in-person provider if necessary.

3. Telehealth Consent & Acknowledgment
By using our telehealth services, you agree that:
   • Telehealth involves audio, video, and electronic communications for remote diagnosis, consultation, and treatment.
   • The provider cannot perform a hands-on physical examination, which may limit the ability to fully assess certain conditions.
   • There may be technological limitations (e.g., internet failure, audio/video lags) that could impact treatment quality.
   • You may be required to perform self-assessments (e.g., range-of-motion exercises) under provider guidance.
   • You understand the risks of unauthorized access to your data despite our HIPAA-compliant security measures.
   • You may withdraw consent for telehealth at any time, but doing so may affect your treatment plan.

4. Emergency & Urgent Care Disclaimer
Our virtual physical therapy services are NOT for medical emergencies. If you experience any of the following, but not limited to, you or your caregiver should immediately call 911 or seek in-person medical care:
   • Severe pain or sudden loss of function in any body part.
   • Symptoms of stroke or heart attack (e.g., chest pain, shortness of breath, numbness).
   • Fractures, open wounds, or severe swelling requiring emergency treatment.
   • Loss of consciousness, dizziness, or uncontrolled bleeding.
Our providers will not be liable for any delayed medical attention resulting from the misuse of virtual services for emergency conditions.

5. Fees, Payment, & Insurance Reimbursement
   • Our practice operates on a cash-pay basis (out-of-network).
   • Full payment is due at the time of service unless otherwise arranged.
   • We accept all Credit/Debit Cards, HSA/FSA cards, Apple Pay, Google Pay, and PayPal. We also accept payments through Zelle. Please send us the message from "Contact Us" page or e-mail us to info@resumemobilitypt.com, if you want to send the payment through Zelle.
   • Superbills may be provided upon request, but we do not guarantee insurance reimbursement.

6. Financial Agreement
   • This practice is cash-based and does not accept health insurance. We are considered an out-of-network provider for the insurance companies. Payment is due at the time of service.
   • Currently, we are not accepting patients with Medicare and/or Medicaid. We do not accept or participate in any other health insurance networks. If your insurance plan provides out-of-network benefits, you can request the reimbursement from your insurance company for our services.
   • You understand that no claims will be submitted to insurance on your behalf, and it is your responsibility to check whether your insurance provider offers reimbursement for out-of-network telehealth services.
   • You acknowledge that you will not attempt to submit claims to Medicare, as virtual physical therapy may not be reimbursable under Medicare guidelines for cash-based providers.
   • Refunds will not be issued for completed sessions. If you need to reschedule, you must provide at least 24-hour prior notice to avoid the cancellation fees.

7. Cancellation, Rescheduling, Refund, & No-Show Policy
   • Appointments must be canceled or rescheduled at least 24 hours prior to a scheduled PT session to avoid the fees.
   • Cancellation fee of $30 will be applied to any No-Shows as well as any cancellations or rescheduling requests made within 24 hours of a scheduled PT session.
   • Late arrivals will not be provided additional time. If the patient wants additional time, we offer extension at $25/per additional 15 minutes (depending on PT's availability).
   • Payments are non-refundable once the PT session has started.
   • We reserve the right to discontinue our services to any patient for repeated cancellations, rescheduling requests, or non-compliance with our scheduling policies.

8. Privacy & HIPAA Compliance
   • We comply with the Health Insurance Portability and Accountability Act (HIPAA) to protect your health information.
   • Your data is stored securely and will only be used for PT evaluation/treatment and administrative purposes.
   • You are responsible for ensuring a private, secure environment when participating in virtual PT sessions.
   • We are not responsible for breaches of privacy due to your internet connection or the use of non-secure networks.

9. Technology Requirements & Limitations
To access virtual physical therapy, you must have:
   • A stable internet connection (high-speed recommended).
   • A camera-enabled device (smartphone, tablet, or computer).
   • The necessary software or telehealth platform installed.
We are not responsible for technical failures on your end that prevent a successful session.

10. Assumption of Risk & Limitation of Liability
By using our services, you agree to:
   • Assume the risks of virtual physical therapy, including misinterpretation of symptoms, lack of physical touch, and technology-related issues.
   • Release Resume Mobility Physical Therapy, LLC, its providers, and affiliates from any liability arising from the use of telehealth services, except in cases of gross negligence or intentional misconduct.
   • Agree that our total liability shall not exceed the amount paid for services rendered.

11. Intellectual Property Rights
   • All videos, exercises, documents, education material, and content shared during treatment are protected by copyright.
   • You must not record, distribute, or reproduce any materials without our written permission.

12. Termination of Services
We may discontinue our services if you:
   • Provide false or misleading health information.
   • Engage in abusive, harassing, or inappropriate conduct toward our providers.
   • Repeatedly fail to adhere to our payment or scheduling policies.

13. Governing Law & Dispute Resolution
   • These Terms & Conditions are governed by the laws of South Carolina & North Carolina.
   • Any disputes shall be resolved through mediation or arbitration before litigation.

14. Amendments & Updates
   • We reserve the right to modify these Terms & Conditions at any time.
   • Continued use of services constitutes acceptance of updates.
